I have 5 children and have not paid rent in 10 days in Florida how quick can I be evicted?

Chapter 83 of the Florida Statutes outline the steps needed to evict a tenant.

1) The landlord first has to give you a 3 day notice demanding payment. The 3 day notice does not include Saturday, Sunday, or any holidays... so a notice issued on Friday would require a reply by Wednesday.

2) Tenants who do not pay rent after receiving a 3 day notice will be issued an eviction summons. The summons will be served either by a process server or a county deputy sheriff. The amount of time between receiving a 3 day notice and a summons depends upon how long your landlord is willing to wait before going to court. Once the summons is issued, it will also take time for papers to be served.

3) If for some reason, you cannot be reached to be served with a court summons, the summons will be sent to you by certified mail.

4) Once you receive a summons, you will have five days (not including weekends) to reply.

5) If you fail to reply, the landlord may request a motion for default and receive a final judgment for possession. If this happens you will have 24 hours to vacate.

The entire eviction process can take place in as little as 9-10 days.

Will you be able to pay them, have you contacted them and asked for terms to work out the rent.
