Hi my roommate was given a ticket for open container but she had no knowledge of the container in my car I completely forgot it was in my car a friend left it under the passanger side seat when I had given her a ride home one evening and forgot to tell me about it. Now my roommate is sitting in jail because she got the open container ticket just because it was under seat but didn't even know it was in the car. They put her in jail for a violation of her probation. How long will she have to sit in jail before she can see a judge and can I not get the ticket put on me since it was my car and will she get another chance for probation or will she have to serve her time

Go to her violation hearing and tell the judge what you told us here. He MIGHT believe you, or he might not.

I was a PO for 7 years and it sounds like we are talking about two different issues here. You say she was put in jail for a probation violation? You can't be put in jail for a probation violation unless a judge has found you guilty of violating probation or a warrant was issued charging her with violation of probation and she is in jail waiting for the VOP.
Perhaps you could be a little more specific about what happened.
If a person is on probation and "gets a ticket" for open container, that shouldn't violate probation because there is no conviction, the charges could be dropped.
In my state a person would sit in jail about a month waiting for a VOP, but there would be a bond review hearing before that.
