My husband bought me a car but didn’t put in my name for control reasons. I drive it every day & he drives his own. I'm leaving him because of verbal & mental abuse. If he calls the police on me for stealing the car does he have a case, or is it community properties?

Thank you very much for your response. I have another one. If I file for separation in the state of California, will I be able to keep the car? For a while, I don't want him to know were I'm at for my safety, will I still be able to keep the car with him not knowing were I'm am?

Community (marital) property laws depend on where you live. It's a pretty safe bet though that this will not be prosecuted if they even listen to him. Its not theft.

You MAY, however, not be able to keep the car once the divorce proceeds... but even then, its likely that you will get it in the divorce agreement. The fact that his name is the only one on it will likely not matter much.

It depends on what you mean by "keep the car." Keep in the sense of having the car assigned to you as yours in the legal separation? You will probably be able to have temporary exclusive use of it until the case is over (you can ask a judge order that if you like and you will probably get that), but I'm not sure what you mean by keeping it. More details would be helpful.
