View Full Version : Case was dismissed then redocketed

So back in November of 2007 I received a motion to appear on an old debt that I believe is past the SOL. I filed an answer with the court within the time frame stating that I don't owe the debt. I never heard another word, until this week when I received something from the attorney requesting it be re-docketed because the original creditor had not yet supplied evidence of the debt, in order to get a default judgment. Naturally I was alarmed, and when I went to the court website today, I see that the court dismissed and disposed in April, but as of today, it has been re-docketed and the court approved the case to be reinstated. How can they do this when I answered the summons and it's clearly on the case summary that I did?

The case was probably dismissed without prejudice, meaning it can be refiled. Just show up at the new hearing and plead your case.
