My ex-fiance is fighting me for joint custody and I only want him to have supervised visits until he goes through AA and gets sober, after that he can have unsupervised visitation. Can I get supervised visitation based on the fact that when he did take care of my son when we were together, he neglected to feed him properly, bathe him, and not drink around him, and also that he was an alcoholic and a violent beligerant drunk when he would drink? For example, when we were togther I would be at work and he was supposed to be responsible for watching my baby and by the time I came home he would be wasted, and then the day before I left him he came home drunk and went outside and broke half of our patio funiture and immediately presided to go to my son's room and pick him up out of his crib and wouldn't allow me to take him. These are justa few examples. Now when I got pregnant I knew he had drinking problems, but because he got a DUI he said he was going to get help and stop, but as I got further along pregnant, he started drinking more, and after I had my baby he would spend very little time with him, or put his own needs before the babies.

You can request it but you can't demand it. Its up to the courts to decide. Take what evidence you have and present your case.

Unless he admits it, what proff do you have, police reports, witnesses and so on.
Drinking of course is legal, proving he was a danger to the child is what you have to do.
So get all of the evidence that will be allowed in court

I think your request for supervised visitation is entirely reasonable and I would expect the court to go along with the request if you tell a judge just what you told us here.
I've seen supervised visitation orders issued in milder cases of alcohol abuse than you've described.
