my son has this psychotic, now it's ex, girlfriend who constantly starts fights with him, in front of his kids, by hitting him screaming profanity at him I mean just constant controlling rage and tantrums. Well recently she started a fight by waking him from a deep sleep by slapping him as hard as she could and screaming accusations at him. He woke up mad and shocked while she was still screaming and hitting and throwing stuff at him, so he grabbed her by the back of her hair and pushed her to get her off him. Well she hit the wall and fell and grabbed her cell phone to call the cops saying she was being abused. My son took off and later was arrested for spousal abuse. I have bailed him out 2 days later but after he was booked and I called and got bail and his charges and court date info. Well by the time I collected money for a 5,000 dollar bail. Another charge was filed on willing cruelty on a child and his bail jumped to 50,000 dollars! My question is... how can a new charge be added while he is in custody? And can he turn the tables and file charges for being wrongfully accused of a crime that he is totally innocent of ? Actually all these charges should be hers! My son is such a good guy and has been a single father of 2 toddlers that he adores. He is a hard worker and dedicated family oriented person. He has had only 2 girlfriends in his life one is the mother of his children the other is this girl I'm writing about who he met online and hasn't had a moments peace since. She definitely has mental problems! Please help =(

Have you called a lawyer?

Not yet I just got him bailed out late yesterday. The painting company he was working for went bankrupt so he doesn't have much money for a lawyer. Any money he makes is from him husseling up side jobs from passing out flyers that he had made trying to start his own business. Which she also took all of his new clients numbers he had and called them telling them that he is going to prison for 20yrs on attempted murder charges! Do you believe that? And he only found this out from a client that had already paid for materials and was waiting for my son to start painting his house the day my son was arrested. Also she is still in his apt. and unless he wants to be around her he is forced to stay at his sisters with his 2 kids. Cause she calls , cops, battered domestic hotlines, cps, anyone that will listen to her lies and come to her aid, in which my son leaves cause now he is scared to death of cops believing her and him going to jail and in turn eventually losing his kids. You have no idea what this person is capable of she has stalked, harassed, promised, lied, broken windows, tried kicking in doors and made calls to his jobs, clients , landlord anyone and done anything to destroy him cause he wants out of this relationship.

She sounds like a total spaz. Charges like this can haunt a person. I would deffinetly seek out legal help.

she definitely is that and them some. And yes these charges are costly and life altering. We are going to do all that we can in searching out some type of legal help and/or advice. Well thanks for your imput. I will try and do some more research in regard to the law and trying to turn this around. My poor son... =/ thanks for your time..

New charges can be added at any time. I'm sure you realize his mistake was taking off instead of staying following what she alleges was abuse.

He sounds like he qualifies for Court-appointed counsel. Has he applied?

No he hasn't been to court yet he spent all last week in and out of court house filing restraining orders and custody papers. He had to postpone his court date because she left town and went with her dad about 4 hours from here. He called the sheriff dept. there to see if they could help. But all he knows are their names he doesn't know the address . He does have a p.o. box but the sheriff said they can't serve orders to a p.o. box. How can he handle this. I don't think she should be allowed to get away with all she had done by simply leaving town. She should have to answer to making false reports and also after CPS talked to my son's neighbors and made copies of the statements they made I'm sure they would like to talk to her again and make sure her kids are not being abused by her... because she don't need to have those kids she is going to end up seriously hurting them.. mentally and physically...

Then you have to get her address - it will cost some money but hire a licensed private investigator to do so.

We can't afford a private investigator. I'm on a fixed income and my son's company just went bankrupt. We struggle to make it from paycheck to paycheck. And now he has that 50,000 bail bond to make payments on and those family and friends who put up the bail...
