No you can't. If you do, you can be sued BIGTIME. In fact, she's established residency, so you're going to have to evict her according to your states landlord tenant laws.

I was afraid of that, see it's my son's question and this girl has filed false abuse charges, had him arrested after brusing herself, and calls the cops yelling that " He is hitting me again come quick! " every time he comes by. Which I have been with him and witnessed this while he is still sitting in the car next to me =/ OK well thanks for excon.

If there's violence, or the threat of violence, he COULD file for a restraining order. That'll have the effect of evicting her.

great thanks.. he had plans of filing a restraining order today.. I just got him bailed out yesterday. I told him to add my name to restraining order too... in case she manipulates him into letting her stop by for any reason what so ever that way I CAN CALL COPS MYSELF!! In the request for a restraining order you need to specify that she is making false police reports in an effort to avoid eviction.

She files a report of domestic violence against you. If you want a restraining order against her, you need to explain why. The key to doing so is that she is filing false reports.

What will hjappen to her depends on the local prosecutor.

Also make sure he does not go near her alone for any reason what so ever.

hi scott, I have another question for you. My son has been going back and forth to court all last week filing that restraining order and also trying to file for custody of his two kids from his first girl friend, who is in drug rehab =/ . Anyway that one girl who had him arrested also told cops that while he was beating her up he took a break to smoke a cigerette then put it out on her kids bed and went back to beating her up again =/ so they added a charge of willful child cruelty. Anyway CPS came to talk to him and his kids and after meeting him and seeing all the statements that his neighbors wrote they admitted to prejudging him before meeting him.. sorry... I'll get to my question.. he now has to serve papers to this person but she has left town with her dad who lives about 4 hours away.. how can we get papers served if we don't know where she is? Cause I think he should see about getting her in trouble for making false allegations and slander.. and after statements CPS probably want to check on her kids safety... thanks...

You have to have a process server serve the papers. If the process server can't find her, you may be able to do service by posting in a local newspaper.

Posting it in the local paper of the town she is in or the paper in the town we live in , where this all took place. Oh and does that cost anything or is it like when they list foreclosures and such ?

In the town where you think she lives. There should be a fee. But this is all part of hiring the process server.
