Hi,
I got my OPT & completed but haven’t completed my Bachelors because of a project which extended for more than 1 year as it was a complicated project by the time my degree catalog had expire and the University wants me follow that by taking 2 more courses; then only they will award my Bachelors degree.
Right now I’m enrolled in Masters. I’m expecting to complete my Bachelors my end of summer or max by Dec 09 and my Master’s next summer. What are the problems I will face when I file for H1 next year? I know it would be big hassle but let me start preparing for it! Please help.

You must have be awarded the bachelors degree to be eligible for an H-1B, unless you have the educational/work experience evaluation to show you have the equivalence.

The USCIS uses a 3 for 1 formula. 3 years of progressive experience in the industry is equivalent to one year of full time study. Your attorney would adjust that formula accordingly to the 2 classes you are short (will depend on the credit hours), and then submit to an accredited evaluation agency.

Best advice, start early. H-1B's are still almost out for this FY even with the slowdown in the economy. Next years allocation will go much faster (IMO).

Thanks for your response, My main concerns is USCIS would make a big deal or not on my graduation date, my degree would say 1.5-2 years from my OPT expired date. What are the precautions can I take to void such Queries?

They don't care about the graduation date, you must have the degree to qualify for the H.
