This is my question. In July, 2008 I was involved in a car accident that was not my fault. The other car ran a stop sign and hit me causing my car to swirl out of control, hitting a parked car. I recently received a summons with my name on it, as well as the person that hit me. Both names were on it, from the owner of the parked car. It instructs me to go to NYS Civil Court within 30 days(20 days if hand delivered which it was not). I contacted State Farm, who was my insurance company at the time of the accident. The summons states that I MUST APPEAR within the days specified and answer summons. The lawyer that is assigned to me from State Farm is instructing me not to worry about it since he already contacted the attorney on the summons and I do not have to appear in court and he will answer summons. This this is a civil case and if I do not appear can a warrant be put for my arrest? Should I follow the advice of attorney?

It's an insurance matter - State Farm will appear on your behalf. Believe State Farm's Attorney.

You hit the parked car and caused the damage. This is your fault. State Farm will "probably" pay the claim and then move against the insurance company for the vehicle that hit you. There is no direct connection at this point between the car that hit you and the car that you hit. You are the connection between the two of them.

State Farm should explain this to you.
