View Full Version : Can I enlist in the Military with a Felony and Misdemeanor?

Hello, I just happened to come across this website moments ago and I am in a bit of a pickle right now, I am wanting to enlist in the military, (Marine Corps preferably, if not then the Army). I have lived a long rather hectic life, I am 20 years old right now, but most of my teenage years were spent in trouble for various things, and so I am here to ask for help.

At the age of 13 years old I was charged with Child Molestation I, and so begins a long turbulent journey in my life. The situation was it was a party for an older cousin (I believe he was in his 30s at the time), I had been drinking a lot of soda beings as that has always been my kind of addiction. Eventually I had to go use the restroom really badly and I raced in, the bathroom stall was locked and at that age I had a paranoia about using the standup urinals, after peeking between the cracks I noticed it was my cousins son inside inside (Lets just call him Bobby). I kept telling him to hurry and that I had to go really bad, shortly after he opened the door and I barged in, quickly unzipped and began to relieve myself. Bobby remained in the stall standing behind me and as I zipped up another person came into the bathroom, in a panic I quickly shut the door and told him to stay quiet.
That man who came in told us to come out because he had heard me, and we both left. Later that night Bobby's parents questioned him asking him if I had touched him and stuff. I believe he was 9 at the time, or 10 I can't remember its been 7 years.
The next day I am being driven to an Attorney by my parents, confused like no other and I am told what I am being charged with, I had never even heard of that crime before. For a year we fought, I denied, I took a few polygraph tests denying anything ever happened and I came out truthful with each one. In one time he attempted to identify my genitals, and failed to do so completely. Yet I was still found guilty and sentenced to 1 week in Juve, 2 years probation, 2 years in SODDAA (Which I completed successfully with flying colors). I was relieved of the obligation to register as a level 1 when I was 16.

I stayed out of trouble, never got any probation violations or anything.

Now when I was 17 is where the misdemeanor comes in. Long story short, my girlfriend at the time disappeared, I was called in to help look for her along with her family and we failed to find her. She arrived back late in the morning, I questioned her over the phone but she refused to say anything so I shrugged it off. In the morning she invited me over to drive her to school, a usual thing we did at the time as we went to school together.
I confronted her about it but she was acting very out of it, as if something traumatic happened. I assumed the worst thinking she had been raped, and in a panic stupid me bit her on the shoulder and left a faint red outline. Now keep in mind, we had always been a biting couple, biting was nothing new to her and I as we did it all the time.
The bite didn't work, I drove her to school and her friend who hated me basically took her to security because her shoulder was sore from the bite and filed a report, the school pressured her to sign it and that led to a JUVENILE Assault 4 Domestic Violence.

That's my record and my story. Ive had recruiters say they can, and others say they cant. The ones that told me they could process me are gone now, I had to wait till off active probation before going back and none of them are still around.

My DV didn't fall under the Latenburg Amendment either so I can still possess a firearm.

I would make a great Marine or Soldier, I am hard working, driven, I have high morals and ethics, and I never give up either.

Please, any advice, insight, anything would be of great help.

Ok well my fiancé is a Marine, he is 20 and has been in the Corps for about 9 months. I believe since it's the time of war they will take you, they will take just about anyone right now its ridiculous. Just ask around for your nearest recruiters office, they will anser your question up front if you ask.

You need to start early and get a waiver for your criminal history to join,

I would say a much better chance with the Army

Unfortunately your answer will more then likely be no. Especially because of your first charge. The military does not condone that and although it was a misunderstanding that got out of hand you were still fond guilty and that is all that the military will care. Unless you can get the charges sealed or thrown out there is almost no chance of being picked up for service. I wish you the best of luck in trying to serve but even with a war going on they are continuing to downsize the military and making it harder to get in. Good luck and if you get in remember to keep your head down and do your job.
