My husband is an illegal Mexican immigrant working in this country illegally. I know that the intending immigrant (my husband) can be considered a household member on the I-864a if he can show that his income will continue from the same source after acquistion of permanent residence. He intends on keeping this job for a long time, however, he is working illegally. Can we still include his income? He makes triple the amount of money I make! Otherwise, we'll need to have a joint sponsor in order to have the necessary income. (125% above the poverty line) :confused:

The CIS will not allow his income since he does not have work authorization. Have you consulted with an immigration attorney? You need to be sure you can file and your husband qualifies for adjustment of status.

If he overstayed a visa, then you can file for him. If he entered EWI, he needs to be grandfathered for section 245(I) or he will be subject to the 3/10 year bar under section 212(a)(9).
