View Full Version : How can I cease to be under my father's jurisdiction of I am under 18?

I have a lot of family problem... the most recent would be the fact that I want to live with my mother, but my dad has custody.

So, I'll explain my situation:

My mother is an ex drug addict, it's been a year since she has used drugs. Though she occasionally drinks and she does smoke. Anyway, my dad was a severe alcoholic up until about 8 years ago. My parents got a divorce, and my dad got custody because at the time of the divorce, my mom WAS using illegal substances. Now it's been 3 years since then, and my father and DO NOT get along. I get home from school everyday and I sit in my bedroom. I'm not allowed to see my mother, just because my dad can make that happen, and just because my brother lives with her (whom my dad hates with a passion.) I am home everyday, I can never leave the house, because my dad always assumes that I'm going to do bad things. I can tell you that while I have tried drinking before, I have never smoked or done any type of drug, and I don't plan on it. I am a social retard because I can never hang out with my friends, while my younger sister can do whatever the hell she wants to. The only reason she can do that is because she is exactly like my dad, and she doesn't like our mom. Living with my dad has brought me to the point where I cannot take it much longer, I don't know how to talk to people professionally, I am never sure of myself, etc.

I want to know if there is a chance my mother can get custody of me with her history..
Or if not, is there a way I can exempt myself from his custody.

Mom needs to go to court to file for a change in custody. Whether she will get it or not, I don't know. But if you are being held a prisoner in your home, that is not going to be looked on well by the judge.

I would talk with your school guidance counselor because being held prisoner is a form of abuse and they will need to report it.
