Im trying to move out of my current apartment. Into a section 8 property. My year lease was up in February, when I had planned to oragenly move. But I was informed that they had signed me to a extra 6 mo lease because I was a day late at that point. While I was going to try to leave it out but have enever ssigned anything about it again. My section 8 voucher is going to run out and I'm going to miss the oppertunedy of using my section 8 what can my landlord legally ask me to do. Is the extra 6mo lease binding

You can tell the landlord your circumstances as soon as possible and give him a letter in writing about your situation.
At worst, if possible, take the sect 8 and pay him what he says you owe. You would be paying him it anyway if you had stayed.

Hello j:

I have NEVER heard of a lease that automatically extends itself because you paid a day late. You MUST have a copy of that lease... But, it doesn't matter if you have a copy or not. It won't change the law.

Write your landlord a letter. Inform him that when your lease expired, it converted to a MONTH to MONTH. Therefore, he will receive 30 days notice when you vacate. Tell him further, that if he doesn't like it, he can sue you. Send your letter certified, return receipt requested.
