I am having a baby in North Dakota and I don't know what I should but on the birth certificate. I am married but have been separated for some time, planning on divorce. I am pregnant with another mans child and will deliver soon. Can I put this other man on my child's birth certificate. What do I need to do this. Does the man I am married to have to sign something saying this child isn't his. He knows it is not. It has never been a secret. Please tell me what I have to do to get the correct father on babies birth record.

You don't not need to put any name on the Birth Certificate at all hon. You may leave it blank.
Realistically, you should not put the name of a man that you know is NOT the father.

You said you are not married but your separated from your husband right now. However, your still married until you get a divorce from your husband.
If you know who the father of the child is then you can put the father of the child on the birth certificate.

Will the father of the child be there to sign the birth certificate ?
Will he want to be part of the child's life.
Do you need a DNA test to prove he is the father.

Another thing is that your husband may be responsible for this child regardless of who the bio dad is unless the bio dad challenges it because your still married and from the sounds of it haven't filed anything with the courts.

First, a birth certificate is a legal document. Its not a good idea to falsify a legal document. If you don't list anyone, then your legal husband will be assumed to be the father and this may be more difficult to change later.
