I acutually was not married or divorced. My ex and I broke up when my daughter turned 2. Its been hard. I have no support and we both have lawyers and he believes he can get emergency custody of her and full.:mad::mad:

Your lawyer has not filed for support?? Get a new lawyer or get on that right away. Don't worry about what your ex says. Everyone threatens everyone else with "I'm getting custody." Get support immediately!

Courts will not change custody without probable cause. He would have to prove, abuse or neglect or a change in circumstance that leads them to believe the child would be better off. Not paying child support makes it close to impossible for that to happen. According to the court that makes him a deadbeat.

He has not been ordered by a court to pay support so none is owed. He is not a deadbeat - just a bad parent.

And custody/visitation and child support have absolutely nothing to do with each other.

He may not be ordered to pay child support yet but it is frowned upon if that is used as an excuse to not participate in the financial responsibility especially if there is no doubt of paternity.

If he were to move for custody with her paying 100% of the child's expenses, it does affect a custody hearing negatively, you're right child support in itself is not related to visitation or custody but it does weigh on the case. The only reason there is a separation and that is to keep from one parent withholding parenting time on the basis that child support is not paid when in reality the most important thing is really the time with the parent (if you ask a child). If he were not paying her a set child support but was covering insurance and paying half the daycare without the order it would posatively affect his case.

Deadbeat- bad parent... fair enough, not dead beat, but bad parent, the point was the court takes into account who is being responsible for the child.
