My daughter turns 18 in May and graduates in June. I would like to ask my ex to continue to pay support through the summer as I have another child that comes home from college for the summer as well. The children normally live with me 80% of the time when they were in school and 80% of the time in the summer as well. Utilities, groceries etc... just go up with all the kids home for the summer, as well as getting another child ready to attend college in the fall. I am only interested in continuing payments at the same amount as they are now through August. Is this worth pursuing?

Can't hurt to ask him. If you normally receive payment through the state, which will cease, you can just ask if he will write a personal check for the summer months. He might be willing to continue, or he might be willing to pay a portion of it. Of course he is not legally obligated to.

The kids could also try to get summer jobs, although not always easy to find at the moment, and contribute a bit each month.

Child support usually does go through their college years. If she is going to college definitely take it to child support court.
If she is not going to college I am not sure if it is worth pursuing.

When support ends is generally written into your divorce agreement. If its not, then state laws prevail.

If either states that support will end before the summer, then the courts will not grant you an extension if he doesn't want to pay.

So the best you can do is ask him to voluntarily continue. If he refuses, I would not bother going to court on the issue as you will likely lose.

Why not have the kids get summer jobs instead?

If your divorce paperwork says child support ends at age 18 or upon completion of high school, no judge will order that the child support be paid through the summer just because you have added expenses due to the kids being home during the summer!

If your ex does not want to voluntarily pay anything, that is his prerogative as he's already paid for how many years.

If she is going through college than go after it ecspecially if she stays with you, but you should also know that if she moves away for college than she can take her father to court for the child support since she is still attending school.

You have to indicate what state your child support order is from because this varies considerable from state-to-state. Some states allow for college-level support, others do not.

Ok. Im sure all of us appreciate that you want to help here but you need to start getting your facts straight. Children CAN NOT sure parents for child support. The only condition that can occur in is if the child support is in arrears and has become part of an estate ( the mother having passed away ). Your not entitled to education beyond high school. Please be more careful in your answers or if you have it.. do the research and post the links for laws. That way we can make informed decisions.
