View Full Version : How do you file a motion to vacate a judgement

A summons came to my dads house, mind you I haven't lived there since 2001. My divorce lawyer is taking action against me for some contract issues. I dropped my case and worked things out. My case was dropped in 2005, she got appointed to judge, now after she is no longer judge, she filed , I never got the summons, and just found out at work about a wage garnishment.

First you need to physically go to the courthouse and look through the court file and see just how this wage garnishment was filed and how you were supposed to have been served.

I looked on the courts website and suppos. It was done in 2008 on April 10, at 10 39 in the morning sighned by my dad. There is only one problem with that my dad is a Dr. and he is never home that early, and he even said he didn't sighn anything.

So you go to the court that issued the judgement and ask how to submit a motion to vacate. But that will only be a delaying tactic.
