I just moved into my new place April 3rd. Today April 23 I got a letter in the mail from the realestate company saying the house was going up for auction. My landlord never told me that that was happening or near happening.

Is there some sort of leagal action I can take? It just seems like he should have known that this was going to happen. It's been less than a month!

I'm just a college kid renting a house, this is way over my head.

Is the bank foreclosing on your landlord's mortgage?

Yes a foreclosure requiries a lot more notice. You can check with the county clerk's office, which can tell you when the foreclosure process started. It is still possible for the owner to pay his arrears and forestall the foreclosure, but if an auction is imminent, that's unlikely.

So your options are to try and find another place, then sue the landlord for your moving costs. Of course if the landlord is in so much financial trouble that he is letting the house go in a foreclosure, its going to be hard for you to collect.

If the place is actually sold, the new owner may very well want to continue renting it to you.

The we're hoping that the case is that the new owner will want to rent to us. I talked to the people holding the auction for the house and they said that that may very well be the case. I have my fingers crossed. Thanks everyone who replied.
