My boyfriend right now is in probation for domestic violence.and in march of this year 09 he was pulled over by a chp because he thought my boyfriend was swerving.but in the dv case he had been under the influence.and in this recent one he had taken a shot. The blood alcohol content was .05 and it was the limit for a person under 21.my boyfriend is 19 and has court on may 18 in fresno,California.can he be arrested on that day if it shows and should he get a lawyer.and should he also report it to his Probation Officer or can he do the same thing.

This is a new charge and yes, he does need to notify the PO before the PO notifies him and that would be another violation if he didn' notify the PO of more police contact.

The PO always needs to know what is happening, failure to tell them is often considered a more seroius violation that what the person did.
