My ex and I have joint custody of our daughter(3 years old) I being the mother have primary, he see's her every other weekend and so forth. We have had this in good working order until recently I moved out of a boyfreinds house into my own apartment. No problems there until more recently I started moving into my new boyfreinds house. Now the father is calling with threats of lawyering up and not giving our daughter back the end of his visitation this weekend. On grounds that my new boyfreind is 20 years older than I am and that I am making a bad judgement call. He now believes this is grounds for him to have full custody? Is this true?

Is custody and visitation court ordered?

It is unlikely your new relationship will be enough for a court to change custody. If the visitation is court ordered and he refuses to return the child, its going to be harder for him to convince a judge.

No and if he fails to return your daughter on time he could actually lose visitation.

Court ordered, that is why I'm hoping it is solid, he has tried pulling a lot of stunts, the judges here hate him for wasting their time.

Moral judgments about a parent's lifestyle choices have no place in a custody decision (assuming those choices are legal). That you have a new boyfriend or that he is older is none of your ex's business. It's as simple as that.

If this is a small community and the judges are aware of his actions, then I would worry even less. Definitely an arbitrary violation of a court order is going to cause more trouble for him. He's likely to be forced into supervised visitation at the least.

So I wouldn't be concerned
