I have a set of twins from a previous relationship. I have already gone to court for sole legal and physical custody and won. What I want to know is this:

I have remarried my first husband (not the father) but when I gave birth to the kids I was still married to him so my name on their birth certificate shows my current last name as my maiden name. Can I change my children's last name (currently their bio father's) to my last name? If so, how would I go about doing this?

I live in southern CA.

Will the bio-father consent to a name change? If so, it is a simple matter of going to the courthouse and filing the correct request (they will have to tell you which... it varies by location). There may be some minor court fees involved.

If the father will not consent, you will need to get a lawyer and petition the court for the change.
