View Full Version : Charged for Moving out upon Lease Renewal

Hi all here's the jist:

I moved out of a place in Florida called Sable Chase on 30th September when my contract was up. I called them 3 months prior and told them this and was instructed to just drop the keys off they will note in my record. I went in every month after which to pay my rent and then called once again in September to inform them of my move and for parking for the truck to move out with.

I then received a call from a credit collector stating I owed them 1400$ for a Late Lease Termination Fee? I stated that I had called and spoke with the rep numerous times but they said "Too bad. Pay it or its going on your credit report." I check my credit report and it is on there now.

I made numerous attempts to call Sable Chase for them to provided a copy of the lease. They are stating that it was required for a signed document stating I was moving out for them to process it properly. I wasn't informed of this at any time during my calls, rent drop off, or returning the keys to the front office. My lease is MIA (Missing in Action) due to the move and what not. They will not even provide me with a copy and keep getting the run around from both Creditor and Sable Chase. Is this possible and what do I need to do to get it off my credit report?

This is not an answer it's a little more information. So I contacted the Credit Collector to get a more itemized invoice on the charges. I then asked for the proof that I was required to submit a signed document stating that I was moving out. The Collector was unable to provide a copy of the lease or any documentation stating that this was in the lease or apart of any agreement. It was quoted "Most lease's that I have seen have this clause so you have to pay." I hope this helps with any information I can be provided

Contact the credit agency and tell them that the credit mark is not valid.

If they go to court and get a judgement against you, THEN they can add it to your credit report. Until then it is not a valid debt.

However... there is a good chance that if you did not give them the notice in writing then your lease automatically rolled over and you may owe this.

Also however... some less than reputable property management companies do this as a practice just because it doesn't cost them anything to try.

Let them sue you for the money.

And under no circumstances should you acknoledge that the debt is valid.

I have contacted the Credit Collector. This is already on my credit report and they never asked for me to go to court or anything. They threatened me with that a couple of months ago and I said fine lets go, but I was never contacted or notified of a court date. I also signed a paper a couple of days prior to moving out stating that I was would be moving out on this date. Signed another one when I dropped off the keys. Still they no one is talking and I am just being told to pay it. Something isn't adding up.

Don't talk to the collector - contact the credit reporting agency directly. Each will have a process to dispute items on your credit report. Check out their websites. Or spend the $20 or so and join one of the many credit report companies that will help you dispute incorrect items.

They can talk forever... but until they get a judgement, its not really a debt.

Yes as steve said do not ever talk to the collector on the phone, in fact write them and tell them that this is not a valid debt and not to contact you further on it ( thus stop any phone calls) contact the credit reporting companies that are showing this and inform them that this is not a valid debt and you wish to have it removed.
