Hello,

I worked for the comapny-A in NJ and worked from jan-08 to nov-08. In Nov, I took intra company trasnfer and moved to same company-A in NY. I got one paycheck of 15Dec-31st Dec from Company-A of NY.

My company sends me two W-2 Form.

My questions:

1) Do I need to file for both NJ and NY State taxes?
2) In My W-2 NY filing state copy has my yearly income of the whole year, where in NJ filing state copy, it shows my income from NJ branch (i.e. up to Nov-08). How can I file my taxes with these two W-2?

I appreciate you people's help!

Best regards,

- Sam

1) Is any W2 marked Corrected?

I think what your saying is that one W2 shows the entire wages earned from both locations (hopefully this has corrected checked) and the other only shows part which is already covered in the other W2?

Hello,

Thanks for the quick response:

No, none of the W2 is marked as corrected. It is marked as Page-1 and Page-2.

On page-1

Federeal Filing copy wage and tax statement indicates income of my last pay check.

NY sate filing copy wage and tax statement indicates income of my whole year.

On both the W-2 I have NJ state filing copy wage and tax statement. (One indicates my income from jan-nov and other indicates my income of decemeber only.)

Please advise!

Thanks,

- Sam

If I file both W2 forms, my income of the 2008 will be more than I actually have earned! And I will be ended up paying taxes on income, which I never had! :(

Sam:

At this point you might file for an extensions and then try to work this out with your employer to get corrected forms. I looks like you would need two W2-s for each state that you worked in and file taxes as though you worked in two states if you have a state income tax and use both new corrected W2's for Federal.

If you can't resolve the issue, the IRS has a way to file with an "incorrect W2". Be prepared to document.
I believe you will have to show why you believe it is wrong.

So, I think these are your options.

You can always file as an "incorrect W2" and then amend your return when the company fixes it.

I had to do the incorrect W2 a long time ago.
