View Full Version : Filed 1040EZ through turbo tax instead of 1040NR

Hello,
I am an international student from India, I graduated in may 08 and since then working on my OPT. I used turbo tax and filed my tax using the form 1040E, it was also accepted but I have not received my refund yet, I have also filed my SSN and medicare tax refund forms 843 and 8316. Now I realised that I should have filed 1040NR. What should I do to rectify my mistake and also will there be any problem because of this in getting back my SSN and medicare returns.
Please advice me as to what is to be done now.

You can file a Tax amendment return using form 1040X

You will not get FICA taxes back from IRS as you have filed resident tax return.

The Form 843 will be rejected. However, you can amend the annual tax reurn and attached a properly-prepared Form 1040NR-EZ and Form 8843 to the Form 1040X and ask to have your non-resident alien status re-instated.

Once the IRS accepts the amendment, then re-submit the Form 843 and 8316.
