I was recently served with papers from Capital One over a debt of about $1200. Since defaulting on my payments, I've not been in contact with Capital One or their debt collectors. They've left messages on my voice mail, but have never spoken to me.
I know I should deny deny deny until they show proof of my signature, but my question is that since I am unemployed, what is my best course of action? Should I even show up to court?
I'm the mother of 3, and recently graduated and will be looking for a job in the next month or so. My husband works full time, and at the moment I don't believe I am on his checking account. I'm listed on the checks, but the statement always comes in his name only and one of the tellers one time told my husband I was never put on the account. I know.. weird. But still.. I know I should go and remove myself fully from his account just to be sure.
My main question is.. the only thing I own in my name is a car. Its worth about $5000 and I wasn't sure how it worked. I've never filed bankruptcy and don't plan on it, I just want to know if they can physically take anything of mine, namely my car.
