View Full Version : Parents do not have custody do they have to pay child support

Hello,
We have taken temporary custody of our 13 yr old nephew. The father is in prison and Mom was found unable to care for him. We are looking at a legal change of custody in early April. However, Child Support Enforcement Agency has started paperwork for getting child support from Mom. If we get legal change of custody will she still have to pay? We don't really care about the money - we just want him in a safe environment and he hasn't been while in her "care".

Technically yes, she will have to pay. But honestly, if you don't care, no one else will either. But right now its in CPS's court.

Child support is paid by the non custodian to the custodian. Unless you adopt the child, support will still be applicable.
