Our landlord in Texas usually required a tenant to sign a one year lease but agreed to allow us a 6 month lease if we prepaid the total lease. We signed the lease in October 2008 and then advised the landlord in January 2009 that we had purchased a home and would be vacating the property at that time. We asked, if he was able to re-rent the property before our prepaid lease was up, would he then refund the amount that was left? He was able to re-rent the property to a new tenant who did take possession in February and advised us that he had to withhold $100.00 of our security deposit due to dirty carpets and that he would not refund ANY of the prepaid rent, even though he was able to find new tenants immediately. Is he allowed to receive double rent for the 3 months left on our prepaid lease, while also collecting rent for the same property from the new tenant?
