View Full Version : Filing an Amendment and adding 1099G information

Hi,
I have posted before on this site and you had given me the advice of filing an amendment because I did not claim the India-US tax treaty as a deduction but rather claimed by state tax as a deduction.
Since I claimed my state tax as a deduction and because I got a rebate on that state tax I received a 1099G form IL with my refund on it which I have to add to my income in this years return.
However when I do file my amendment for 07 I will not claim the state tax as a deduction and hence my state tax rebate won't be part of my 08 income anymore.
I already contacted the IDOR and they told me not to add the amount in the 1099G to this years return as I am planning to amend it.
I just want to confirm if this is in fact correct because the person who answered my call at IDOR did not sound very confident in his answer.

Please let me know if I can file the returns for this year without adding the 1099G amount.

PS- I am filing my returns for 08 before filing my amendment for 07.

Normally, if you have filed amendment, then you do not report 1099G as income.

If you did not file amendment, then 1099-G is income. And if you later on file amended return for 2007, then you can also file amended return for 2008.

But if you are soon going to file amended return, then you may not claim 1099-G as income. But do not delay your amended tax return.
