View Full Version : My son's father passed away I want to get his name on the birth certificate

My son's father passed away while I was pregnant. He acknoledged that he was the father and we were engaged to be married when he was in a car accident. His whole family knows that he is my son's father and love our son so much. But when I signed the birth certificate at the hospital they said that I couldn't write his dads name because he wasn't "there to sign it himself". Both of his parents were there and wanted to sign for him but weren't allowed to. Now 14 years later my son and I still don't have the satisfactory of having his dads name on the birth certificate so we have never ordered it. Neither one of us want one without his dads name on it. I have gone to the local court and they say they don't have anything for this procedure. They only have name changes and obviously that's not what I want. Can you help lead me into the right direction to have my sons dads name put on my sons birth certificate?

You could go to court and file to have a DNA test done on your son's father's relatives. That would establish paternity. You should be able to have the birth certificate changed if you have proof of paternity and a death certificate showing that the father is deceased.
