I moved into an apartment on Feb. 28th. I received a notice of prorating my next months rent. I expected to pay for the one day I moved in early, but the manager is saying my rent is from the 28th of Feb. to the 28th of March and that I will have to pay extra for March 29, 30 and 31. Is this legal?

That seems odd unless rent is due on the 28th.

No, it is NOT legal... You pay by the MONTH - not the day...

If he doesn't buy this, and he probably won't, because he sounds like an IDIOT, ask him if the rent is different for the months with 30 days as opposed to those with 31??

If he DOESN'T get it, MOVE.

What does your lease say about when rent is due and what period it covers?

Only addressing NY - if you move in ONE DAY EARLY you owe for that entire month. For example, you move in January 31st instead of February 1st and you owe for the month of January. Many landlords waive the rent for that one day (as I do) and I've never seen a landlord prorate by the day nor do I understand why your landlord is doing this.

As Scott asked - what are the terms of the rental? From what date to what date?
