Hi;
We live in Pennsylvania, and my husband worked 100% in New York state. I have my own company in PA, and pay estimated taxes. His company withheld NY state taxes but not PA. I thought that we would be getting taxes back from NY to pay PA, however it looks like we will get minimum back from NY and owe allot more to PA! It seems that we are paying both states. Did I miss something when I did our state returns? It sure does not seem fair!

If you are present in a state, then any income earned during this period, must be reported to the state.

To your resident state, you must report your worldwide income for the year.

If you live and work is a state but your employer is from another state, then your income is only subject to the state where you live and work. Read: Your U.S. Tax Return: Working or Living in Two or More states (http://taxipay.blogspot.com/2008/06/working-in-two-or-more-states.html)

Assuming you have filed by now, I hope you claimed the credit on your PA return for the NY state taxes paid, which should have reduced your PA tax liability significantly.
