I was beaten pretty bad and peppersprayed while handcuffed in jail. I filed a complaint and was told it is on video. Internal affairs has the video I would like to retrieve for my own defense. How do I get the video on my own. It happened 6months ago

Your attorney can get a copy of this video. Hopefully you have retained an attorney to handle this for you.

Thing is my lawyer doesn't want them to know he is putting together a case yet
I feel he is going to put it off for too long and I won't get any compensation. Please let me know how I would go about doing this myself.

I filed a complain about 6 months ago. I was told there was video and they did violate policies while handling me. I would ike to know how to get the video myself just to be sure. It is pretty much the only evidence I have. Please tell me how I get it.

You need to subpoena it as part of the Court proceedings - I'll be amazed if it's still on file after 6 months unless you filed notice that you will be requesting it and "they" were ordered to save it.

I answered your other thread on the same subject - please don't keep posting the same question. It takes time away from other questions and you are going to continue to get the same answers.

I will be surprised if the video exists - Police usually don't save videos of handcuffed prisoners being beaten up and pepper sprayed.

If its with Internal Affairs, it may still be kept. But I think your attorney needs to ensure that evidence is preserved rather then worry about them knowing he is building a case. But since he's the attorney of record, HE needs to subpeona the evidence.

I don't know why he's hiding. As a matter of fact, he should have filed the case right away. What is the benefit of waiting?? I only see negatives by waiting, but I ain't no lawyer.
