I used to live over a year ago in dupage county, Illinois. There is a divorce going on, I signed an temp. agreement to pay rent, bills, but lost my job, still unemployed. Filed a potition to modify it, now the apt complex wants to take me to court along with ex for rent, lawyer fee's etc. EX is still enemployed, receiving state benefits, that I'm not shure what they are. What is the laws about my situation, not living there for over a year and still being on the lease? IN Ilinois

What notification to the landlord that you were leaving and asked to be taken off the lease at the renal did you give them

I didn't give proper notice I left, Verbally I've been in the office to let them know. I never signed to take my name off the lease or anything. I let them know I no longer resided there, that my ex's (Real soon hopfully) new girlfriend/lover was living there, as she has denied, and that I have a court order to pay the rent in a temp agreement giving a divorce still not settled yet. She still refuse's to get work, and was also ordered to resonably seek for work. Ive filed petion to modify marital expense's. Now I'm going to court for a forced entry and detainer. I think its to gain acess and seize any remaning property to pay the back rent, and lawer fee's assiated with the lease. The lease also states any one there more than 14 days concecuativly is considered a resident. Ive been out for over a year and odered to not enter the apartment.

Doesn't matter whether you live there or not. If you didn't report that you moved out, in writing, and that you wanted your name off the lease, then you are responsible for the rental.

Who ordered you not to enter the apartment, the landlord, or the ex though a court order.

The soon to be ex through a court ordered agreement, she had an order of protection out on me which ironically dropped the first day it was to be heard, never went into the court room for it. But I signed an agreement to pay the rent, and not go there in a dazed mindset. Its common from what I hear for wive to pull such a stunt. In some case's its absolutely necessary, but in my it's a classic case of faslefying reports to her gain evidently. I just want to end this all fair and hopfully equally but many case's don't from reading. I've got to tackle this first court date thing claiming back pay for rent and lawyer fee's. I only agreed because I didn't want my daughter to be on the streets, and it was or felt like the right thing to do even though she had the affair, which has no meaning in court as I understand. Im asumming I might be stuck by the so called temp. agree meant which stated until further court order, I have before being served this summon in forcible entry and detainer. I was giving this through my mother from the soon to be ex, Don't even know if this was served properly to me? With all this I don't know whether I'm still responsble or not... She paid the jan rent but defaulted on feb. and apparently has enough money to be moving into another apartment in May
