Hello,

I worked for last 2 years (2007 on F1-CPT and 2008 on F1-OPT) with an employer based in NJ and lived there for 2 years (more than 183 days in calendar year as mentioned on NJ Tax Division website regarding domicile, etc) and maintained my legal residence there. Would like to know if I come under NJ resident or non-resident/part year resident?

I filed last year NJ 1040 Form, but would like to know if it's right or not? As far as federal is concerned, I come under Non-resident status but what about the state? And how can I calculate my state taxes to know if I owe or overpaid?

And also, I haven't received 1099G but I'm confused was I supposed to get one (I got state refund last yr), whom should I contact for this. Assist.

Thanks !

For federal you are nonresident for 5-years. Same rule does not apply for states. You are resident of NJ.
