Dear,
I am international student. I used form 1040 for Resident instead of 1040 NR for non resident last year (to file for Tax 2007). Thus, I got like the $300 from the stimulus bill last year and also some money from the earn income credit (which I was not supposed to have). I want to amend my tax now. I found the form 1040X, which may be the right from to amend my tax to be correct with my status. However, I have no idea how to fill in the form. Do I pay for penalty if I amend my tax now ?
Thank you

You will file Form 1040X along with properly done Form 1040NR or 1040NR-EZ and Form 8843.
If you owe tax, only then you will also pay interest and penalty. You can request for the waiver of penalty. Read: Your U.S. Tax Return: U.S. Tax Filing Requirements for Non-Residents (http://taxipay.blogspot.com/2008/03/us-tax-filing-requirements-for-non.html)

I went to a free tax service at my school (VITA). They wasn't able to prepare for an amendment and told me to go for a tax service, but they said it may cost me a couple of hundred bucks. I don't know who can help me in this situation, since I don't want to close my door for green card application in the future. Could you please tell me where should I go for help ?
Thanks a lot.
