SIR,
My house owner is in kerala . I came to his house in tamilnadu for rent for rs. 3750 in May 2007. In the agreement he stated that the increase in the rent in the nest year will be max. 10%. I gave him the rent by way of crediting in his bank account every month before 5th of the next month without fail and delay even a day .
But in December 2007 he phoned me and ask me to pay rs. 4000 as rent from April 2008; I objected and finally agreed; then in February 2008, again he phoned and demanded me rs. 5000 from April 2008. I strongly objected but agreed later ;
Then he made an agreement with rs. 5000 as rent from April 2008 [ please note that the increase in not max. 10% as in the earlier agreent but nearly 33% ] and an increase of max. 10% in rent from march 2009. I as earier send rent by crediting in his bank a/c. but now he phoned me and says that I shall pay rs. 6000 as rent from march 2009.[ please note that the increase is not 10 % but 20%] every time he increases as he thinks.
What can I do in this situation ? He tells something in the agreement and tells another thing later. He goes on increasing rent by rs. 1500 first time within 11 months ; then after 11 months again by rs. 1000. If I refuse to pay the amount he demanded , I am asked to vacate the house immediately. Is there any legal remedy for me to continue in that house without any disturbance from him until my payment of rent in a regular manner.

Please answer as early as possible.

First its not a good idea to piggyback your question on someone else's. This can lead to confusion. You should start a new thread. So I've moved your question to its own thread.

I don't know the laws where you are but contract law is pretty universal. If you have a written agreement that says something, then he can't violate that agreement. However, I'm unclear as to what your agreement is.

You started the lease (for a year I assune) in May of 2007. If the lease states that he can only raise the rent by 10% max, then he could not charge you more than 4100 starting in May 2008. However, if you agreed to something else then things are changed. Did you sign a new lease in May of 2008? Where the terms the same?

Sir,
I have not signed in the present lease agreement so far; but if he asked me to vacate immediately what legal action can I take to continue in that house without any problem from him ?

You can't. You need to check the laws governing eviction for your area as well as what the last signed lease says. He has to follow them, so he can't just tell you to get out immediately. But I doubt if you can extend your tenancy more than 30-60 days.

If you don't pay the full rent or sign a new lease, he can terminate your tenancy. If you refuse to leave he can evict you. What the process is and how ling it takes depends on local laws.
