View Full Version : Probation Violation: Leaving the State without concent

Ok here's my situation, I'm on felony probation in IL, trying to get my probation transferred to Michigan, but until then I'm not supposed to leave the state without proper consent.
Now lets say I left the state anyway but I'm still reporting every month to Chicago and doing everything else I need to do, my PO is clueless, and I'm not giving him any reason to be suspicious of what I'm doing. IF he somehow were to find out what's the LEAST and WORST he could do? What do YOU think he would do? Assuming he's a pretty nice guy. And also if the police were to run my name in this other state (where I'm not supposed to be) would it show up that I'm on probation in another state? Assuming I don't have any warrants in that state. Speedy advice would be appreciated, thanks!

The scenerio you have outlined is going to come back and bite you in a very uncomfortable place.
If you are found out to be in that other state without permission expect to attend a VOP hearing after you've been in jail at least a week or more.
Your judge could decide to reinstate your original jail time or give you more probation.
Felony probation for what? How long was your original probation for?
How are you supporting yourself in Michigan?
And yes, the cops can tell if you are on probation in another state due to NCIC so don't think you'll just skate down the road on that one.

Twinkledooter, thanks for your input. It gave me something to think about. I know this would be a risk but it was literally my only choice. I have no family in IL, no job, in bad situation with drugs and bad people trying to "get" me.
My charge was retail theft of $800 in merch. It was my first charge EVER. They sentenced me in January 09 to 2 yrs reporting probation. And I'm reporting every month so no reason to put a warrant out on me. You say they will see I'm on probation on IL will that also show the fact I'm not supposed to be out of state as part of my probation requirements? I could just tell them my PO gave me the OK to come to MI to see my family or something. Do u think they would buy that one?

Yes, that "nice" PO may not be so nice if he finds out he is being lied to. Most likely he would have a warrant for your arrest made up and brought before the judge to see if they wold send you to priso
If you get stopped for speeding, or running a red light, or if a old friend gets mad at you and calls it in. 100's things can happen to turn you in.

I left the state a long time ago and when they catch me, I'll fight it! I shouldn't even be on probation. I was accused of a crime I did NOT commit. I only plead guilty so that I could get out of jail. Then they expect me to pay them over $3600.00. I'm not paying them ing . I'm innocent!
