View Full Version : Court age for children who want to live with other parent?

I am not sure if I posted this in the right forum.
But I have a question.
My stepdaughter recently moved to Maine, about 6 months ago. She recently told me and her father that she wants to come live with us. She is not happy with her mother anymore. She is only 10 years old and the state we live in she has to be at least 12 or 13 years old to beable to tell the courts where it is she wants to live.
I don't know how to find out the age for Maine. So that is why I am here.

The law states that she can decide when she is 18. Before that it is left at the discretion of the court. As a minor she cannot legally decide anything. The non-custodial parent would need to go to court and request primary custody. The court *may* then ask the child what her desire is. They may not.
