Hi I worked on Cpt for 6 months in 2008.I filed 1040 form my 2008 tax returns I got the money also but my friends are saying we need to file 1040 NR-eZ is that true, what is the difference between 1040 and 1040 NR EZ please reply me if any one knows.Any help os appreciated.

On F1/CPT you are exempt from residency for 5-years. You must file non-resident tax return Form 1040NR or 1040NR-EZ and Form 8843. Your income is not subject to FICA taxes but you must pay federal and state income taxes.

Hi Mukata,

Thanks for your reply, I filed with one tax professional he said we have to file 1040 form I don't know why he did for me :( is there any way I can correct now?I already got my tax money what should I do now,will it be any problem for my H1?Please help me what should I do now

You need to amend the return with Form 1040X and attach properly-prepared Forms 1040NR-EZ and 8843 to the Form 1040X.
