I've been living with a roommate for 5 years now. I have no written contract so I guess it's month to month rental. She's on the lease and has been for 25 years. I recently found out that I have been paying for more than 3/4 the rent due to rent control from her being there so long and she's been selling pot which I suspected. She always has guests and friends come over to stay. Her dog s every where and when I want to have company or family come over she throws a fit. A little upset I have become.

Do I have the right to get on the lease and ask her to move, do I have a right to fair share of the rent. Should I just move out?

Personally, I would move out. I would not want to be associated with someone who is dealing drugs. This sounds like it may end up being more trouble then it is worth. Can you find somewhere else to go?

No, of course you have no right to "get on the lease" that is her lease between her and the property owner or management company

You rent from her, you may ask for a leease from her but that is it.

So what if you are paying 3/4 of the total rent, I would assume for 5 years it is a fair rental for the area.
She could charge you more than she pays if that is a fair and going rate for a sub lease.

If you just want to cause her trouble for some reason
1. see if she has the legal right to sublease, perhaps you are a illegal tenant,

But this is her apartment, and basically if you don't like living there you are the one to move
