Hello,

Circumstances: on 29 month OPT
graduated: Dec 2008


Hi i am in OPT period, if I applied for a H1 B through and Employer in the month of april( since it is a lottery system) and If it gets picked up. will i still be able to file an extension of my OPT for 29months and work on My opt instead of working on H1 till the OPT expires.
Please Do advice it urgent:)

OPT is a function of your F-1 status.

You can only be in one status at a time. If your OPT is extended (E-verify enrolled employer?), you should begin working on the H-1B on October 1. this will allow you to work and apply for a visa.

Please note that the CIS intent for the OPT extension was not to extend the time in the US for authorized employment, but to bridge the gap (cap gap) between the academic calendar and the fiscal year (on which the H-B visa allocation dates are based).
