When the upstairs apt flushes there toilet it comes up in my tub and commode

Do you have the lowest fixtures in the home? If so, then it sounds like the MAIN DRAIN LINE may be clogged.

Usually, this requires a snake to be sent down the drain to unclog the pipe. Are you the owner or do you rent?

If you rent then call the landlord and let him know you have an emergency on your hands. If you own either call a plumber to snake the drain line or you could RENT a large cable machine at a rental store and attempt to unclog this yourself.
