I'm currently "Sub Leasing" an apartment in Denver. The tenants had to vacant pretty quickly with 6 months still left on their lease. The property manager is aware of the situation, but as of yet we have not been issued any agreement of our sublease in writing. It was my understanding that the current person on the Lease is responsible for any rent and charges due and that we would pay them any balances paid to the landlord. The person I am sub leasing from never paid the rent and sub sequentially we incurred a late fee that we have to pay. Not really sure what to do here, the management company will not give me any documentation on our sublease and conveniently enough I can't get a hold of the person attached to the lease. So we have signed nothing and seen nothing which illustrates the conditions of a lease (even after I requested) but now we are responsible for a late fee and I'm just really confused on where the responsibility lies here. Please Help.

You do not owe the management company anything since your agreement is with the original tenant. However, the management can start eviction proceedings if they are not getting their rent paid. Have you started paying the management company directly?

Yes. I paid the rent as soon as I realized that it was not going to be paid by the person attached to the actual lease. I fully intend to keep paying the Rent. I just wanted to be excused from the late fee that was incurred. I do not feel that I should pay this fee when I took it upon myself to pay the rent directly (one day late). I feel that the fee should either be excused or sent to the person attached to the lease for their negligence. The management company tried to tell me I owe it because it would violate the Fair Housing Act if I was excused the fine
