I don't work in 2008 but I did start college and am paying tuition... and I also had a baby... I am married but wanting to file separately... will I get anything back?

If you didn't pay any taxes because you didn't work, what do you expect to get back? I'm a little confused.

Well I know I won't get anything back... thats not what I meant... I mean do my baby and I qualify for a stimulus check

As far as I know that hasn't been brought to a vote in Congress, yet.

You should file married and let your husband claim you and your child. That is the only way you will get any money.

I can't file married because if I end up being able to get a check then it will not be able to go to my son because my husband has back child support and the whole refund will be taken. My son will get nothing

Well, if you haven't paid any taxes out then you don't get anything back. I don't know what you should do. You husband should have been paying child support for the other kid that he had.

Its not his fault... he didn't know anything about the kid until she was 6 years old

You can file Form 8379 (Injured Spouse Allocation) with the return and claim the child under YOUR side of the refund. That way, at least some the refund will go to you and your child.
