View Full Version : Can a landlord agent file a unlawful detainer

I have rented my brother townhouse but the tenant has not paid rent & utilities for last three months. The lease is between me and the tenant and my brother has given me power of attorney to manage and take care of his townhouse. The tenant only paid first month rent to me.

My question is who should be the plaintiff? My brother or me?

My earlier case was dismissed because I filled the unlawful detainer the same day I gave notice. Now I don't want it to be dismissed on basis of plaintiff.

Can I file multiple unlawful detainer? One my brother as plaintiff vs tenant and another as me as plaintiff vs tenant.

You have power of attorney. You rented to the tenant. You are the plaintiff..

No, you can't file multiple suits.

What you SHOULD do, is READ your states landlord/tenant law. If you knew the rules, you wouldn't be making the mistakes you're making... We HAVE a copy of them right here at the top of the real estate page on a sticky note.
