View Full Version : Incapacitated parent on quit claim deed

My sister and I were told to put our names on our parents deed. They own the home free and clear.
Is the quit claim deed best way? We were told to do joint tenants. What if one of them or one of us does not die but becomes incapacitated and we needed to or wanted to sell the home? My parents are 90 and 91 - good health physically and mentally at this point. They have a will. Would it be OK to just leave everything as is - will, durable power of attorney, and medical power of attorney?

Normally the power of attorney will allow you to sign for the other person, but if they get where they need someone to be a guardian, then that legal status may be considered.
