I was in US for the past 8 yrs as software engineer and came back to Inda in May 2008 once for all. Regarding 2008 Tax return in US, After going through various websites including IRS.gov, I found that I have to file 1040A, because I qualify as resident alien, as I pass the substantial Presence test.
How do I do it. Can I do it online through e-file? Or should I post the form with indian address and get the tax refund by Post ( I don't have any US bank account now)

Baan66:

For 2008, you are a dual-status alien and must file a dual-status return, which cannot be filed electronically, but rather must be mailed. You will get the refund via the mail in the form of a check.

If you are not a U.S. citizen or green card holder, you are resident up to May 2008 and non-resident for the remaining year. You will file Dual status return. It is a non-resident return with statement return (resident return) for the resident period.

In that case I have the following doubts.
1. What forms should I use to file the return?
2. How do I calculate my income, Tax and refund ( I have NO income other than W2)?
3. Am I eligible for Child tax credit?
4. Do I need to show the income I got in India for the rest of the year ( Which is no way connected to US)?

1. Read IRS publication 519: Tax for Aliens, page 33, Dual Status Return.
2. You will not get standard deduction. On non-resident return, you can get itemized deductions.
3. No one can tell unless you provide more info about your child.
4. No.

If your child is a U.S. citizen (due to he/she being born in the U.S.), then, for sure, you can claim the Child Tax Credit. Otherwise, probably not.
