Good afternoon,
I would like to know if I will receive a tax refund from my unemployment benefits, or am I just getting a refund from the months that I was employed in 2008. I know that they take taxes out of my unemployment check, but am I entitled to those ? I know that I have to include that on my taxes along with the w-2 from my employer.
Thank you

If income taxes were withheld from your unemployment benefits, assuming that your total tax does not exceed the amounts withheld or paid-in, you would be entitled to a refund.

Unemployment payments are considered income to you. You will need to add the amount of the payments to your taxable income. You will then add the amounts withheld to the rest of your withheld payments.

You then calculate the tax on your total income and determine whether its more or less than the amount withheld to determine whether you get a refund or not.
