i had a lease dec 2007-dec 2008

That means is expire and i am in month by month, but i didnt pay anything yet, this is why:

1. first i was going to leave the 15th of january, so i gave them notice, but i cancel dec 26th, because i was going to renew. i never signed that renewal.

2. jan 2nd, i discovered that my dad is sick so i have to leave. they want me to may now 2 moths rent on a monthly rent basis.

can they do that? i am leaving in two days. i would pay for 1 month but not for more.

i live in texas so i dont know by law wich are my rights.

You owe them for January and February if you did not give written notice of your intention to vacate before January 1st.

You need to give them 30 days notice or else pay for those 30 days. The notice must be in the same time frame as you are responsible for rent, in this case I would guess it's the 1st of the month, which would be notice prior to January 1st to vacate February 1st.

Did you read that I said you have to give notice before January 1st in order not to owe February's rent?

No, January 2nd is NOT before January 1st so, yes, you owe rent.
