Can I file my new born on my taxes if I haven't worked this year? If so how do I file him

The short answer is yes, you can claim your newborn as your dependent on your income tax return. I am making the assumption that you have already requested a social security number for your baby, if you have not, please do so as soon as possible.

As a follow-up, if you have not worked, you and or your child might be eligible to be a dependent of another person (the one who supported you, IF applicable). If you truly had no income, you may want to consider what type of tax advantages it may have to the person supporting you if they claimed the dependency deduction.

In order to file a tax return, you must have taxable income. Unless there is taxable income, there is NO requirement to file a tax return and no possibility of claiming your child.

Now, if you are married, you CAN file jointly with your spouse and claim your son as a dependent.
